Understanding your Upnetic Legal Benefits

UPNETIC LEGAL SERVICES


This article provides information on how to access your benefit, as well as detailed plan benefit information. Legal services are provided by Legal Club of America®, a third-party vendor.

How It Works

  3. Connect with attorney

SECTION 1: ELIGIBILITY & PLAN USAGE

Business Eligibility

All HR Pro clients are eligible for the Upnetic Legal Plan, including non-profits. The plan is designated for use by the business only and may not be used by employees of the company or for personal legal matters.


To Receive a Plan Attorney Referral

You may contact Upnetic by phone or online to request an Upnetic Legal attorney referral. There is no limit to the number of referrals you may receive.

Option 1: Online Attorney Referral Request

Log into your Upnetic account and request an attorney referral at:

https://upnetic.com/legal/

You may choose to:

  • Speak with a Legal Club Legal Specialist (LS) immediately, or
  • Schedule a call for a specified date and time

Legal Specialists are available Monday through Friday, 9:00 AM to 7:00 PM ET.

You will confirm your contact information (name, email, phone number, company name). Once complete, an Upnetic Legal LS will call you at the scheduled time.

The LS will:

  • Confirm your account and case information
  • Refer you to a plan attorney based on area of law, preferred language, and location

Option 2: Attorney Referral Request by Phone

Call the Upnetic Legal Service Team at: (800) 316-5139

Available Monday through Friday, 9:00 AM to 7:00 PM ET.


Messages received after business hours will be answered the following business day.

You will need to provide identifying information to verify membership, including:

  • Email address
  • Name
  • Company name

You will briefly describe your legal issue and will then be connected with a Legal Specialist who will refer you to a plan attorney.

If an appropriate plan attorney cannot be immediately provided, the issue may be escalated to a Manager to ensure the best possible referral. Upnetic will follow up to ensure you receive the best available referral.


Contacting Plan Attorneys

When contacting a plan attorney, identify yourself as an ADP Upnetic Legal Club member.

If the plan attorney is unable to assist you, contact Upnetic for another referral.

Please allow up to three (3) business days for a plan attorney to return your call, as attorneys may be attending to existing clients.


You have access to a nationwide network of plan attorneys who have contracted with Legal Club to provide free and discounted legal services. Referrals are based on language, area of law, and location.


SECTION 2: PLAN BENEFITS

The following six services are available at no charge from the plan attorney:

  1. Unlimited initial phone consultations during business hours for new legal matters (30-minute limit per subject matter). Time beyond 30 minutes per subject is billed at the guaranteed low hourly rate.

    Document review of up to five (5) independent documents per quarter.

    • Business documents and contracts (signed or unsigned)
    • Up to 10 pages each

      Initial telephone calls made on behalf of the business (if deemed appropriate by you and the plan attorney), up to two (2) per month.

    • Follow-up calls are billed at the guaranteed low hourly rate.

      Initial letters written on behalf of your business (if deemed appropriate), up to three (3) per month for new subjects.

    • Follow-up letters are billed at the guaranteed low hourly rate.

      Initial collection letters, up to ten (10) per quarter.

    • Additional initial letters and follow-ups are billed at the guaranteed low hourly rate or contingency fee percentage, depending on agreement with the attorney.
  2. Registered Agent service for your business in the state of incorporation and other states where you do business.

Guaranteed Low Hourly Rates

Plan attorneys have contracted to charge 40% off their normal hourly rate, with a minimum of $125 per hour, for services beyond the free and discounted benefits.


Retainers

For extended legal matters, plan attorneys may request a retainer.

The retainer is calculated as:

Estimated hours × discounted hourly rate

Example:

10 hours × $125/hour = $1,250 retainer

Any unused portion of the retainer will be returned to you.


Contingency Fee Discounts

For contingency matters:

  • Collections
    • 18% if settled before formal court proceedings begin
    • 27% after proceedings begin

      All other contingency matters

    • 10% discount on the lower of either:
      • The state maximum, or
      • The attorney’s standard rate

Court costs, filing fees, and travel time to/from court are additional.


SECTION 3: DEFINITIONS & MISCELLANEOUS INFORMATION

Definitions

Collections Matters

Any matter in which the business is owed money by a debtor, including calls, letters, and court appearances if necessary.

Plan / Participating Attorneys

Licensed and qualified attorneys in their state who maintain professional liability insurance (if required) and have contracted with Legal Club to provide services under this plan.

Plan Member

Any business with an ADP HR Pro membership that has activated its Legal Club membership through Upnetic.

Miscellaneous Information

Upnetic does not provide legal advice. Legal services are provided through Legal Club’s network of participating attorneys.


The following are excluded from discounted rates:

  • Court filing fees
  • Expert witness fees
  • Court costs
  • Court reporter fees
  • Transcript expenses
  • Photocopying
  • Postage
  • Telephone toll charges
  • Travel expenses
  • Any other incidental expenses

SECTION 4: TERMS & CONDITIONS

The following matters are excluded from plan privileges:

  • Legal matters involving jurisdictions outside the 50 U.S. States and Puerto Rico
  • Legal matters where the plan member retained participating counsel at customary rates prior to enrollment
  • Frivolous legal matters (as determined by the attorney under state ethics rules)
  • Any action involving Legal Club, ADP, Upnetic, plan attorneys, affiliated companies, or their directors, officers, employees, or agents where interests are adverse
  • Legal matters against the plan sponsor
  • Matters where a plan member and eligible family member have adverse interests (only the original plan member is eligible unless written authorization and consent are provided)
